Section 1: Powers and Duties
A) The powers and duties of the President shall be:
1) To serve as chief officer of CEC-Ohio with the powers and duties usually belonging to such a position.
2) To call and preside at meetings of the Executive Committee and Executive Board.
3) To preside at meetings of the CEC -Ohio Representative Assembly.
4) To serve as an ex officio and non-voting member of all committees except those making nominations or conducting elections.
5) To appoint all ad hoc and standing committee chairpersons.
6) To establish ad hoc committees as deemed necessary.
7) To appoint or nominate CEC - Ohio representatives to serve on committees, councils, and/or task forces at the state, regional, national, or international level.
8) Prepare and submit an annual set of assurances to CEC by Oct. 1.
9) To delegate the representation of CEC - Ohio in coordinating its work with that of other agencies.
10) To represent CEC - Ohio at the international CEC Representative Assembly.
11) To secure clerical assistance for the CEC - Ohio Executive Board with the approval of the Executive Board.
12) To prepare a written agenda which is received by all Executive Board members prior to Executive Board meetings.
13) To disseminate the minutes of all Executive Board meetings and CEC - Ohio Representative Assemblies.
14) To develop and disseminate a list of Executive Board members, subdivision officers, and chapter officers to the Executive Board.
15) To develop and disseminate a directory of Executive Board members, subdivision officers, and chapter presidents.
B. The powers and duties of the President Elect shall be:
1) To serve in place of, with the authority of, the President in case of absence or disability.
2) To chair the Professional Development Committee and plan the annual convention according to the policies and directives of the Executive Board.
3) To represent CEC - Ohio at the international CEC Representative Assembly.
4) To revise, update, and monitor implementation of the CEC - Ohio action plan.
5) To submit to the President copies of all official correspondence.
6) To attend and report at CEC - Ohio Executive Board meetings, state convention, and CEC - Ohio Representative Assemblies.
7) To assume additional responsibilities as assigned by the President.
C. The powers and duties of the Secretary shall be:
1) To record the minutes and proceedings of the meetings of the Executive Board and CEC - Ohio Representative Assemblies and disseminate as appropriate.
2) To carry on correspondence as necessary for the operation of CEC - Ohio as directed by the Executive Board.
3) To maintain the official approved copy of all minutes.
4) To compile an annual summary of major approved business.
5) To maintain an official copy of the documents of CEC - Ohio.
6) To transfer all records to the new Secretary by Feb. 1 .
7) To submit to the President copies of all official correspondence.
8) To attend and report at Executive Board meetings, state convention, and CEC - Ohio Representative Assemblies.
9) To certify votes for all CEC - Ohio Representative Assemblies.
10) To assume additional responsibilities as assigned by the President.
D.. The powers and duties of the Treasurer shall be:
1) To monitor and disperse the funds of CEC - Ohio as directed by the Executive Board.
2) To assist the Finance Committee in the preparation of the proposed annual budget.
3) To submit a complete financial report at each Executive Board meeting and CEC - Ohio Representative Assemblies.
4) To pay out money for expenses as outlined by the budget or as approved by the Executive Board and with the authorization of the President.
5) To complete the annual forms necessary to file state and federal income tax in compliance with regulations appropriate for tax exempt organizations.
6) To prepare and submit all records for annual audit and submit a written report of findings and recommendations to the Executive Board at the first executive board meeting of the fiscal year.
7) To maintain the official financial records of CEC - Ohio.
8) To transfer all monies and records to the new Treasurer by February 1.
9) To attend and report at CEC - Ohio Executive Board meetings, state convention, and Representative Assemblies
10) Disseminate rebates from International CEC to regions and college chapters of CEC - Ohio within thirty (30) days of request to active units.
11) To assume additional responsibilities as assigned by the President.
Section 2: Removal of Officers
CEC-Ohio officers may be removed according to the following procedures:
1) A petition for removal of an officer signed by at least five (5) active members of CEC-Ohio and outlining the reason(s) for removal shall be submitted in writing to the CEC-Ohio President, or if the subject of petition is the President, to the President Elect.
2) The President (or President-Elect) shall, within seven (7) days, notify each Executive Board member in writing of the receipt of such a petition, solicit relevant evidence from all parties concerned, and call a special meeting of the Executive Board to consider the matter within thirty (30) days following receipt of the petition.
3) The Executive Board shall review all relevant evidence and vote on the petition for or against removal.
4) A two-thirds majority vote of the voting members of the Executive Board is needed for removal. A vote of removal is effective immediately.
5) The officer being considered for removal shall be provided with the results of the Executive Board action in writing within seven (7) days.
6) The officer so removed shall be required to submit all CEC-Ohio records and official responsibilities to the Executive Board within fourteen (14) days.
Section 1: Duties
The duties of the Executive Board shall be:
1) To serve as the administrative body of CEC-Ohio.
2) To act upon such official recommendations, policies, and petitions as they are developed or received.
3) To present an annual budget to the CEC-Ohio Representative Assembly for approval.
4) To monitor official publications of CEC-Ohio.
6) To establish policies and guidelines for the annual CEC-Ohio Convention.
7) To assume all other responsibilities as are, or as shall be, assigned through the Constitution and Bylaws or legislated by the CEC-Ohio Representative Assembly.
8) To act upon the recommendations of the Executive Committee or any of the elected officers, standing committee chairpersons, College CEC-Ohio President, Project Support Chairperson(s), subdivision representatives, or individual CEC-Ohio members.
Section 2: Voting Members
A. The voting members of the Executive Board shall be:
1. Elected officers.
2. Chairpersons of following Standing Committees:
Nominations/Award Membership
Governmental Relations Finance
Publications/Website Public Relations
Constitutional Review Past President's
Professional Development
3. CEC-Ohio President or alternate.
4. Official subdivision representatives or alternates.
5. Project Support Chairperson(s), one vote.
B. Each of the above positions carries only one vote.
Article III
Section 1: Duties
A. The duties of the Representatives to the CEC-Ohio Representative Assembly shall be:
1) To serve as CEC-Ohio's general legislative body.
2) To elect the officers of CEC-Ohio.
3) To approve the rate for the CEC-Ohio special assessments to the dues.
4) To approve a Constitution and Bylaws and to make amendments.
5) To approve an annual budget.
6) To approve the annual financial report of CEC-Ohio.
7) To act on such other official recommendations and petitions as may be received.
Section 1: Nominations/Awards
A. The Nominations/Awards Committee shall consist of the three most recent Past Presidents. The second year College CEC-Ohio Advisor shall serve as a member in the selection of the student award. The Immediate Past President shall serve as chairperson. The duties of the Nominations/Awards Committee shall be:
1) To accept nominations submitted by local regions, subdivisions, and Executive Board members to be considered as candidates no later than sixty (60) days prior to the CEC-Ohio Representative Assembly. Only those members who meet the requirements of the office may be nominated. Nominations for officers will be accepted from the floor at the CEC-Ohio Representative Assembly.
2) To nominate a slate of candidates for office vacancies in the following pattern:
a) president elect every year;
b) secretary every other year;
c) treasurer every third year;
3) To submit a slate of candidates and their qualifications to the Executive Board for approval and to distribute the approved slate and their qualifications to the chapter and subdivision presidents at least thirty (30) days prior to the CEC-Ohio Representative Assembly.
4) To solicit nominations for the Ohio Special Education Teacher, Educator (college), General Educator and Student of the Year Awards according to established CEC-Ohio Policy. To solicit nominations for the Distinguished Service Award according to established CEC-Ohio Policy.
5) To meet to review each nomination according to established CEC-Ohio Policy. To verify the qualifications of nominees and to submit their recommendations regarding awards to the Executive Board for their approval. To notify each nominee in writing.
6) Current CEC-Ohio officers, official voting members of the Executive Board, and members of the Nominations/Awards Committee are not eligible for awards.
7) To solicit nominations for international Council for Exceptional Children awards, and submit recommendations regarding the awards to the Executive Board for approval.
B. The duties of the chairperson of the Nominations/Awards Committee shall be:
1) To be responsible for fulfilling the duties of the Nominations/Awards Committee.
2) To submit to the President copies of all official correspondence.
3) To attend and report at CEC-Ohio Executive Board meetings, state convention, and CEC-Ohio Representative Assemblies.
4) To assume additional responsibilities as assigned by the President.
Section 2: Membership
A. The Membership chairperson shall appoint no fewer than two members to serve on the committee. The chairperson shall serve a minimum of three years. The duties of the Membership Committee shall be:
1) To maintain a record of active/inactive members and to provide a written membership count at each Executive Board meeting.
2) To maintain an active program for the recruitment of new members.
3) To support the international Council for Exceptional Children in its follow-up of membership renewals.
4) To coordinate a membership desk and solicit new members at the annual CEC-Ohio Convention and other sponsored conferences.
B. The duties of the chairperson of the Membership Committee shall be:
1) To be responsible for fulfilling the duties of the Membership Committee.
2) To submit to the President copies of all official correspondence.
3) To attend and report at CEC-Ohio Executive Board meetings, state convention, and CEC-Ohio Representative Assemblies.
4) To assume additional responsibilities as assigned by the President.
Section 3: Governmental Relations
A. The duties of the Governmental Relations Committee shall be:
1) To develop state and national platforms under the direction of the Executive Board.
2) To disseminate pertinent national and state legislative positions to all chapter presidents, subdivision presidents, legislative chairpersons, and the Executive Board.
3) To represent CEC-Ohio as the Children and Youth Action Network (CAN) coordinator to the international Council for Exceptional Children.
4) To coordinate communication between CEC-Ohio and the OCECD.
5) To communicate, as directed by the president, with state and national legislators concerning legislation pertinent to the needs of persons with exceptionalities.
6) To work with other organizations to influence legislation that will assist persons with exceptionalities.
B. The duties of the chairperson of the Governmental Relations Committee shall be:
1) To be responsible for fulfilling the responsibilities of the Governmental Relations Committee:
2) To submit to the President copies of all official correspondence.
3) To attend and report at CEC-Ohio Executive Board meetings, state convention, and CEC-Ohio Representative Assemblies.
4) To assume additional responsibilities as assigned by the President.
Section 4: Finance
A. The Finance Committee shall consist of:
1) The immediate Past President.
2) A standing committee chairperson, appointed by the President.
3) An official subdivision representative, appointed by the President.
4) The Treasurer will serve as an ex officio member.
The President shall appoint the chairperson of the Finance Committee. The appointed representatives shall serve one year terms. They may serve up to three (3) consecutive terms with the approval of each new president and the Executive Board.
The duties of the Finance Committee shall be:
1) To prepare and recommend a proposed annual budget for approval by the Executive Board at least thirty (30) days prior to the CEC-Ohio Representative Assembly held prior to Jan.1.
2) To present the approved budget to the delegates for adoption at the CEC-Ohio Representative Assembly held prior to Jan. 1.
3) To review and monitor expenditures not outlined in the budget at the direction of the Executive Board.
B. The duties of the chairperson of the Finance Committee shall be:
1) To be responsible for fulfilling the responsibilities of the Finance Committee.
2) To submit to the President copies of all official correspondence.
3) To attend and report at CEC-Ohio Executive Board meetings, state convention, and CEC-Ohio Representative Assemblies.
4) To assume additional responsibilities as assigned by the President.
Section 5: Publications/Website
A. The chairperson of the Publications/Website Committee shall serve as the newsletter editor. The duties of the Publications/Website Committee shall be:
1) To develop and present at the first Executive Board Meeting of the administrative year a calendar listing deadlines for the submission of materials and dates of publication for the following year.
2) To solicit from regional presidents, subdivision presidents and Executive Board members material to include in the newsletter.
3) To make arrangements for printing and mailing of the newsletter.
4) To publish a minimum of two (2) newsletters each year.
- To serve as a liaison between the Executive Board and the website manager.
- To solicit information to include on the website.
B. The duties of the chairperson of the Publications/Website Committee shall be:
1) To be responsible for fulfilling the duties of the Publications/Website Committee.
2) To submit to the President copies of all official correspondence.
3) To attend and report at CEC-OhioExecutive Board meetings, state convention, and CEC-Ohio Representative Assemblies.
4) To assume additional responsibilities as assigned by the President.
Section 6: Public Relations
A. The duties of the Public Relations Committee shall be:
1) To promote CEC-Ohio to its membership, the general public, and mass media in the state of Ohio.
2) To disseminate information which will increase the public's awareness of CEC-Ohio and the needs and potential of persons with exceptionalities.
3) To develop, coordinate, promote, and publicize events for Exceptional Children's month throughout Ohio.
4) To promote and publicize the "Yes, I Can" Award program throughout Ohio.
5) To submit all information to the CEC-Ohio President for approval prior to dissemination.
B. The duties of the chairperson of the Public Relations Committee shall be:
1) To be responsible for fulfilling the responsibilities of the Public Relations Committee.
2) To submit to the President copies of all official correspondence.
3) To attend and report at CEC-Ohio Executive Board meetings, state convention, and CEC-Ohio Representative Assemblies.
4) To assume additional responsibilities as assigned by the President.
Section 7: Constitutional Review
A. The purpose of the Constitutional Review Committee is:
1) To update and/or revise the CEC-Ohio Constitution and Bylaws.
2) To disseminate CEC-Ohio Constitution and Bylaws at CEC-Ohio Representative Assembly.
B. The constitutional Review Committee shall consist of the following members:
1) The immediate past president.
2) A committee chairperson appointed by the current President.
C. The duties of the chairperson of the Constitutional Review Committee shall be:
1) To be responsible for fulfilling the responsibilities of the Constitutional Review Committee.
2) To submit to the President copies of all official correspondence.
3) To attend and report at CEC-Ohio Executive Board meetings, state convention, and CEC-Ohio Representative Assemblies.
4) To assume additional responsibilities as assigned by the President.
Section 8: Professional Development Committee
A. The duties of the Professional Development Committee shall be:
1) To maintain an ongoing review of convention policies.
2) To examine and explore professional development opportunities and projects proposed to and by
CEC-Ohio.
B. The Professional Development Committee shall consist of a chairperson appointed by the
President who shall serve a two year term and may serve up to two consecutive terms with the
approval of each new President and the Executive Board.
The duties of the chairperson of the Professional Development Committee shall be:
1) To submit to the President copies of all official correspondence.
2) To attend and report at CEC-Ohio Executive Board meetings, state conventions, and CEC-Ohio Representative Assemblies.
3) To appoint committee members and to chair each Professional Development
Committee meeting and present a report of committee activities to the CEC-Ohio Executive Board.4) To maintain ongoing communication with international CEC Headquarters regarding matters
concerning professional development.5) To serve as a resource to the CEC-Ohio Executive Board, chapters, and subdivisions regarding educational issues related professional development.
6) To serve as a consultant to the annual convention program planning committee.
7) To assume additional responsibilities as assigned by the President.
Article V
College CEC-Ohio Advisors
Section 1: Student Advisors
There will be two (2) student advisors, selected in alternate years. They shall each serve a two year term. Student advisors will be selected and approved in accordance with the College CEC-Ohio Constitution.
Section 2: Duties
The duties of the College CEC-Ohio Advisors shall be:
1) To work with College CEC-Ohio officers to promote statewide student involvement.
2) To provide direction and support for statewide student activities.
3) To assist in the preparation of an annual College CEC-Ohio budget.
4) To act as a liaison between College CEC-Ohio and CEC-Ohio.
5) To submit to the president copies of all official correspondence.
6) To attend CEC-Ohio Executive Board meetings, state convention, and CEC-Ohio Representative Assemblies as requested by the president.
7) To assume additional responsibilities as assigned by the president.
The senior (second year) advisor shall serve on the Nominations/Awards Committee for the selection of the Student of the Year Award.
